Twenty-six Spanish timeshare court victories worth £504,470, including £137,256 vs Onagrup

We are pleased to share our latest Spanish timeshare court victories. M1 Legal secured TWENTY SIX positive awards totalling £504,470. Our highest award in this update was a case involving Onagrup, totalling £137,256.

Below is a breakdown of the key results to date:

1st Court of Instance:

  • Club La Costa x 2 - In Fuengirola, the judge declared the contracts null due to a lack of property and/or contract duration information. Amounts awarded - £11,781, £34,396.
  • Club La Costa - The judge declared the contract null due to a lack of property and/or contract duration information, including associated agreements and the finance contract. Amount awarded - £22,028 plus interest.
  • Marriott x 6 - In Marbella, nullity was declared due to a lack of property and/or contract duration information. Amounts awarded - £10,640, £11,700, £12,593, £13,410, £22,969, £26,796.
  • RCI - In Tenerife, the judge declared the contract null, fully upholding the ruling in respect to Majexo. Amount awarded - £13,690.
  • Heritage Resorts x 2 - In Marbella, nullity was declared in both cases due to a lack of property and contract duration information. Amounts awarded - £10,012, £13,000.
  • Anfi - In Gran Canaria, the judge declared nullity due to a lack of property information. Amount awarded - £26,961 plus interest.
  • Onagrup - In Barcelona, the client's contract was declared null against Intergroup SLU. Amount awarded - £137,256.
  • Onagrup - In the next case, the judgment fully upheld Club Estela Dorada, along with costs and interest. Amount awarded - £31,600.
  • Restotel - In Barcelona, the contract did not disclose the minimum property requirements – a win against Restotel and Club Estela Dorada. Amount awarded - £17,970.

We also received a positive judgment in relation to Vilagia Park.

Appeals:

  • Anfi x 2 - In Gran Canaria, the Court of Appeal declared nullity due to a lack of property information. Amounts awarded - £20,130, £11,286.
  • Infiniti - The Court of Appeal declared the decision in this case null and void due to lack of purpose and the receipt of prohibited advances, confirming that the First Instance judgment still stands. Amount awarded - £14,300.

We also received positive appeal decisions against The Regency Club and Pearly Grey.

All cases mentioned above will now move to the next stage.
