Eighteen Spanish timeshare court wins worth £317,587, including a £66,955 Marriott award

We are pleased to share our latest Spanish timeshare court wins. M1 Legal secured EIGHTEEN positive court awards totalling £317,587. The largest of these results was a case against Marriott, where the court ordered a payment to our client of £66,955.

Below is a breakdown of the substantive outcomes from these recent Spanish court decisions:

First Instance Court (Court of First Instance):

  • Marriott x 4 - In Marbella, the judge declared all four contracts null due to missing information about the property and/or the contract duration (Laws 42/1998|04/2012). Amounts awarded - £16,437, £13,600, £11,675, £14,153.
  • Marriott - In a further Marbella matter, the judge also declared the contract null due to missing information on the property and contract duration. The contract between the claimant and MVCI Holidays S.L. together with MVCI Management S.L. resulted in the judge ordering Marriott to refund the contract price, less weeks used at a rate of £769 per year up to the date of judgment, with interest. The judge also ordered Marriott to repay payments made during the legal proceedings, plus legal interest from the date the claim was filed. Amount awarded - £66,955.

We also received a positive award against Elite Fuerteventura.

Appeals:

  • Club La Costa x 4 - The Court of Appeal confirmed four First Instance judgments declaring the contracts null due to missing information about the property and/or contract duration (Laws 42/1998|04/2012). Amounts awarded - £20,402, £19,110, £34,764, £27,780.
  • Anfi x 3 - The Court of Appeal confirmed three First Instance judgments declaring the contracts null due to missing information about the property and/or contract duration (Laws 42/1998|04/2012). Amounts awarded - £20,179, £11,571, £19,128.

We also received further positive appeal decisions against Tasolan, Club La Costa and Anfi.
