We are pleased to inform you of this week's Spanish court victories. M1 Legal secured TWELVE positive awards with a total value of £182,813. Our highest award was confirmed against CLC Paradise Trading totalling £45,949.
Please see below a breakdown of the substantive results:
1st Court of Instance:
- CLC Sucursal x 2 - In Fuengirola, court numbers four and five, the judge declared the contracts null under law 04/2012, one case was a positive result due to lack of accommodation information and the other case for the contract duration. Amounts awarded - £9,938, £39,572.
- CLC Paradise Trading - In Arona, court number one, the judge declared the contract null under the law 42/1998 for lack of accommodation information. Amount awarded - £45,949.
We also received confirmation of positive judgements against Gestiland 2000 (Club Marino Tenerife), CLC Continental Resorts and also Diamond Resorts.
Appeals:
- CLC Sucursal x 2 - In the Court of Appeal Malaga, it was confirmed that the judgements still stand from the first instance in both these cases, which declared the contracts null due to lack of information regarding the accommodation and contract duration (law 04/2012). Amounts Awarded - £15,807, £20,861.
- CLC Paradise Trading - In Tenerife Court of Appeal, it was confirmed that the judgement from the first instance still stands which declared the contract null due to lack of information regarding the accommodation and contract duration, (law 04/2012). Amount Awarded - £15,975.
We also received confirmation of further positive appeals against CLC Sucursal and another against MacDonald Resorts.
In ten out of the twelve cases this week, we also were awarded court costs.
