Eight Spanish timeshare court awards worth £125,047, including £34,718 vs CLC Paradise Trading

We are pleased to share last week’s Spanish court victories. M1 Legal secured EIGHT positive awards with a combined value of £125,047. The highest award was against CLC Paradise Trading, totalling £34,718.

Below is a breakdown of the substantive results achieved:

First Instance Courts

  • CLC Sucursal x 2 – In both Fuengirola cases, the judge declared the contracts null under the requirements of Law 04/2012 due to missing information about the accommodation and the contract duration. Amounts awarded: £10,584 and £12,739.
  • CLC Paradise Trading – In Arona (Court No. 2), the judge declared the contract null under Law 04/2012 for lack of information regarding the accommodation and contract duration. Amount awarded: £34,718.
  • Restotel (Onagrup) – In Dénia (Court No. 4), the judge declared the contract null under Law 04/2012 due to a lack of information regarding the contract duration. Amount awarded: £28,932.

It was also confirmed that in Marbella we received three positive judgments against Marriott.

Appeals

CLC Sucursal – In Malaga Court of Appeal No. 4, the first instance judgment was upheld following CLC’s appeal. Amount awarded: £15,122.

Jurisdiction

Four positive results valued at £49,024

In all four cases, the defence (Diamond Resorts) argued that the claims should not be heard under Spanish jurisdiction. The judge ruled in our favour in each case, confirming that the Spanish courts are competent to proceed with the claims.

All four cases will now proceed to the next stage.
