We are pleased to share this week’s Spanish timeshare court victories. M1 Legal secured seven positive awards with a total value of £133,804, with an average claim amount of £19,114.

Below is a summary of the key cases and outcomes.

First Instance Court

  • Marriott – The judge declared the timeshare contract null under Law 42/1998 due to missing information about the contract duration. There were three separate contracts in this case, so the award combines USD and GBP and has been converted at today’s exchange rate. Amount awarded: £32,080.
  • Silverpoint – The judge declared the contract null and void, and the case is already included within Silverpoint’s insolvency proceedings. Amount awarded: £22,756.
  • Club La Costa – The judge declared the contract null and void under Law 42/1998 due to a lack of information regarding the contract duration. Amount awarded: £16,944.

Appeals

  • Anfi – The Court of Appeal No.3 in Las Palmas, Gran Canaria confirmed that the first instance judgment stands. The contract had been declared null and void due to missing information about the contract period under Law 04/2012. Amount awarded: £29,988.
  • Anfi – The Court of Appeal No.3 in Las Palmas, Gran Canaria also confirmed that three further first instance judgments stand. These contracts were declared null and void due to missing information about the accommodation and period under Law 04/2012. Total amount awarded: £32,034.
