Over £218,582 awarded in Spanish timeshare court victories in just one week

It has been another record week for Spanish timeshare court victories. M1 Legal secured 11 successful outcomes, with a total of £218,582 awarded.

The individual awards are set out below.

Courts of First Instance (Primera Instancia)

  • Diamond Resorts – Fuengirola Court of First Instance No. 2: the judge declared the timeshare contract null and void under the requirements of Laws 42/1998 and 04/2012, due to missing information about the accommodation and the contract duration. Amount awarded: £15,245.
  • Anfi – San Bartolomé de Tirajana Court No. 3: the judge also declared the contract null and void under the requirements of Law 42/1998 (no information on duration). Amount awarded: £27,399.
  • Club La Costa – Fuengirola Court No. 5: the judge declared the contract null and void due to the requirements of Law 42/1998 (no information on duration). Amount awarded: £38,128.
  • Marriott – Marbella Court of First Instance No. 3: the hearing concluded after the judge declared the contract null under the requirements of Law 42/1998 (no information on duration). Amount awarded: £28,203.

Provincial Court

  • Anfi – Provincial Court of Las Palmas de Gran Canaria No. 5: the judge overturned the first-instance decision. The earlier view was that where Anfi cancels a contract due to non-payment of maintenance fees, there are no grounds for a claim; this was found to be incorrect, and the case was amended in our client’s favour. Amount awarded: £42,987.

Appeals

  • Club La Costa (x2) – The Court of Appeal in Malaga confirmed the first-instance judgments declaring the contracts null under Laws 42/1998 and 04/2012. Amounts awarded: £24,774 and £21,414.

We also secured three further wins: one against Martex, RCI and SSB Marketing, plus two further Anfi judgments.

Jurisdiction

This week we also succeeded in three more cases where the resort appealed in an attempt to have the claims rejected under Spanish jurisdiction. All three were against Diamond Resorts, with a combined value of £35,139, and will now proceed to the next step.
