7 Spanish timeshare jurisdiction wins worth £228,976, plus Anfi and Diamond awards

We are pleased to share this week’s Spanish court victories. M1 Legal secured 8 positive results, with a total amount awarded of £77,134.

The main awards are outlined below:

1st Court of Instance

  • Diamond Resorts – The judge declared the contract null and void under the Law 04/2012 requirements, due to missing information about the accommodation. Amount awarded: £16,796.
  • Anfi – In this case, the judge also declared the contract null and void under the Law 04/2012 requirements, again because accommodation information was not provided. Amount awarded: £22,790.

We also recorded six further wins. Two were first-instance decisions against Anfi and Wayfair. The remaining four positive judgments were appeal wins: three against Anfi and one against Tasolan. Total amount awarded: £37,548.

7 jurisdiction victories valued at £228,976.58

This week, we achieved six jurisdiction victories against Club La Costa (with a claim value of £209,174) and one against McDonalds Resorts (£19,802). The defence argued that the cases should not be heard in Spain; however, the judge overruled this and confirmed that they can proceed. In the six Club La Costa matters, the judge stated that the Mercantile Court in Spain is the correct forum for these cases. The McDonalds Resorts result was an appeal, which M1 Legal also won. All seven cases will now move forward.
