Positive timeshare court victories against Club la Costa, Anfi & Fuerteventura Life – £83,787 awarded

We are pleased to share last week’s Spanish timeshare court victories. M1 Legal secured 8 positive results, with a total of £83,787 awarded.

First Instance Court (Court of First Instance):

  • Club La Costa Sucursal – The contract was declared null due to missing information on the contract term and accommodation details, as required under Spanish law 04/2012. £20,689 awarded.
  • Anfi – The contract was declared null due to missing information on the contract term and accommodation details under Spanish law 42/1998. Court costs were awarded in our favour. £19,108 awarded.
  • Fuerteventura Life – The contract was declared null due to missing information on the contract duration under Spanish laws 42/1998 and 04/2012. Court costs were awarded in our favour. £10,249 awarded.

There were three further positive judgments against CLC Paradise Trading, Anfi and Marriott.

Appeals (Court of Appeal):

  • CLC Sucursal – We won an appeal before the Málaga Court of Appeal. In the earlier decision, the judge awarded only £5,000 despite the clients having paid £35,000. Following our appeal, the judgment was made in our clients’ favour. M1 Legal will rely on this outcome in new cases to support the consideration of previous contracts referenced in the price sheet. £35,131 awarded.
  • CLC Sucursal – The Court of Appeal confirmed our first-instance win. Court costs were awarded in our favour. £23,739 awarded.
