We are pleased to share last week’s Spanish court victories. M1 Legal secured eight successful outcomes, with total awards of £124,330.

First Instance Court (Court of First Instance)

  • Club La Costa Sucursal – The contract was declared null and void due to a lack of information on the contract duration and accommodation details, as required under Spanish law 04/2012. Court costs were awarded. £14,862 awarded.
  • Club La Costa Sucursal – The contract was declared null and void due to a lack of information on the contract duration and accommodation details under Spanish law 04/2012. Court costs were awarded. £10,131 awarded.
  • Club La Costa Sucursal – The contract was declared null and void due to a lack of information on the contract duration and accommodation details under Spanish law 04/2012. £15,897 awarded.
  • Club La Costa Sucursal – The contract was declared null and void due to a lack of information on the contract duration and accommodation details under Spanish law 04/2012. £22,334 awarded.
  • Club La Costa Sucursal – The contract was declared null and void due to a lack of information on the contract duration and accommodation details under Spanish law 04/2012. £15,897 awarded.
  • Majexo Sl/BIC Leisure – The claim was upheld in full. The court also awarded double the amount paid during the cooling-off period, plus costs. £11,994 awarded.

Appeals (Court of Appeal)

  • CLC Continental Resorts – The Court of Appeal confirmed our first instance victory. The court drew a clear distinction between the certificate and the purchase contract; Continental’s attempt to waive the certificate was rejected. Court costs were awarded. £22,659 awarded.
  • Anfi – The Court dismissed Anfi’s appeal and ordered them to pay costs. The appeal argued that the contract had been terminated because the claimants had not paid maintenance fees; the court ruled that only a contract that is not null and void under mandatory law can be terminated. Court costs were awarded. £12,247 awarded.

Jurisdiction Hearings

Four jurisdiction victories valued at £66,511

M1 Legal secured four jurisdiction decisions last week, all against Club La Costa. The defence challenged whether the claims should be heard in the Spanish courts. In each case, the challenge was unsuccessful and the claims will now proceed to the next stage.
