Marriott, Diamond and Anfi: Spanish timeshare court victories since courts re-opened

With the Spanish courts now re-open, we’d like to share our latest Spanish timeshare court victories.

M1 Legal secured three results, with a total amount awarded of £47,544.

1st Court of Instance:

  • Diamond Resorts – The court declared the contract null due to a lack of key information, including details of the property and when it could be used. Total amount awarded: £17,000.
  • Marriott Vacation Club – The court declared the contract null due to a lack of key information, including details of the property and when it could be used. Total amount awarded: £15,875.
  • Anfi – The court declared the contract null due to a lack of key information, including details of the property and when it could be used. Total amount awarded: £14,669.

8 Spanish jurisdiction victories valued at £135,091

M1 Legal also secured eight jurisdiction victories last week, all against CLC (a combination of CLC Sucursal and Paradise Trading). The defence challenged whether the cases should be heard in the Spanish courts. Three victories were at the initial jurisdiction hearing, and five were successful appeals. All cases will now proceed to the next step.
