Last week, the team secured one award at First Instance and four successful appeal decisions, all in favour of M1 Legal.
The Barcelona Provincial Court has now ruled in a complex case against Perblau 2000 and Clubotel La Dorada, fully confirming the First Instance judgment. The lawsuit filed by our team was upheld in full. The contract had been issued by a company said to be based in the British Virgin Islands (BVI), and extensive research was required to demonstrate that this BVI company did not exist. In this matter, the courts took into account all documentation submitted at both First Instance and the Provincial Court. The information obtained also enabled M1 Legal to present robust arguments on the defendants’ passive legitimacy. A significant result in this Onagroup-related case. £10,321 awarded.
At the Court of Appeal last week, M1 Legal reported successful decisions in matters involving CLC Paradise Trading, Anfi Sales SL, Diamond Resorts and Anfi Sales & Resorts. In all four cases, the decisions mean the claims will now proceed to the next stage.
Across 15 jurisdiction hearings last week, the defence argued that the cases should not be heard in Spain. The judge rejected those arguments in every instance, ruling that all 15 cases can be heard in Spain.
