More than £27K awarded in Diamond Resorts court case win in Spain

We are pleased to share last week’s Spanish court victories.

Our legal team secured positive outcomes in 10 substantive cases, with total compensation awarded of £148,332.

The first case of the week was against CLC Paradise Trading. The Court of Appeal in Tenerife ruled in our favour, rejected all elements of CLC’s defence and ordered them to pay costs. Our client is already being included on CLC’s creditors list. £16,643 awarded.

In the only case this week against Anfi Sales & Anfi Resorts, the court declared the contract null due to a lack of key information (including the property and when it could be used). £21,083 awarded.

In the first case this week against Diamond Resorts Europe, the court found a contract nullity due to a lack of essential information (including the property and when it could be used). The related loan was also declared null and void in addition to the main contract. £11,016 awarded.

The largest award of the week was in a Diamond Resorts case. The contract was declared null due to a lack of key information (including the property and when it could be used). £27,783 awarded.

Next, in a case against CLC UK PLC Sucursal, the contract was declared null due to a lack of essential information (including the property and when it could be used). £20,077 awarded.

In a case against Marriott Vacation Club, the contract was declared null due to a lack of key information (including the property and when it could be used). £20,204 awarded.

Finally, we report another case against CLC UK PLC Sucursal, where the contract was declared null due to a lack of essential information (including the property and when it could be used). £12,596 awarded.

Further victories were also achieved against McDonald Resorts, another Marriott and Club La Costa.

In addition, there were also five jurisdiction victories valued at £80,022. All were against CLC apart from one against Marriott Vacation Club. In these cases, the defence challenged the claims being heard in the Spanish courts. Three victories were at the initial jurisdiction hearing, and two were appeal wins. All cases will now proceed to the next stage.
