We are pleased to share last week’s Spanish court victories.
Our legal team secured seven substantive results, with total awards of £106,742. Four of the seven judgments were against Club La Costa, brought under the contractual company names Sucursal and Paradise Trading.
In the four Club La Costa cases, the court found contract nullity due to missing or inadequate information about the property, how and when it could be used, and the contract duration. Awards were: £19,100, £10,431, £17,356, and £17,434.
We also obtained a favourable judgment against Silverpoint. The contract was declared null due to a lack of key information relating to the property, usage and the contract term. We were awarded costs, and £14,100 was awarded to our client.
In the case against Onagroup, the judgment was favourable to our client; however, two additional contracts under the company names Club Estrella Dorada and Clubhotel La Dorada were not successful on this occasion. M1 Legal will appeal this part of the decision. £18,590 was awarded.
Our final substantive judgment from last week was against Albatroz Ventas and Ecomar Continental, where £9,720 was awarded.
Furthermore, there were 24 positive jurisdiction results valued at £466,909. Of the 11 jurisdiction victories this week, 10 related to Club La Costa and 1 to Diamond Resorts. The defence argued that the cases should not be heard in Spain; however, the judge ruled that they can. A further 13 cases were appeals following the last jurisdiction hearing, and we were successful in those too.
