Double victory against Silverpoint: Tenerife court rules contracts null and void, £72,921 awarded

In the first week after the Spanish courts reopened, M1 Legal has reported two substantial wins against Silverpoint in the First Court of Instance in Los Cristianos, Tenerife.

In both Silverpoint court cases, the judge found the contracts lacked essential accommodation details — including when the timeshare could be used, where it applied and what, precisely, the entitlement covered.

In addition, one of the Silverpoint agreements was in perpetuity, meaning it had no end date.

As a result, the judge declared both Silverpoint timeshare contracts null and void and ordered Silverpoint to pay clients £23,657 and £48,264 (a total of £71,921).

M1 Legal also reports two further jurisdiction decisions involving Club La Costa (CLC). Club La Costa argued that these cases should not be heard in Spain; however, the court overruled this and both matters will now proceed through the Spanish courts.

In both CLC cases, the contractual name cited was Club la Costa (UK) Sucursal en España.
