CLC Continental Resorts lose again as Spanish court declares contract null and void, £25,068 awarded

Following an early jurisdiction challenge, Club La Costa argued that the claim should not be heard in the Spanish courts. The court rejected that argument and confirmed jurisdiction in favour of M1 Legal. The case then proceeded to a hearing on 19 July 2019 at the Court of First Instance in Fuengirola, brought against the contracting entity Continental Resort Services S.L.

During the hearing, it was found that the contract did not state an end date (in perpetuity) and lacked key accommodation information that should be set out as a minimum.

The judge declared the CLC contract null and void and ordered CLC to pay the clients £25,068.
