Nine jurisdiction victories against Club La Costa upheld by Malaga court of appeal

M1 Legal are pleased to report nine jurisdiction victories relating to Club La Costa.

Following an initial decision that these claims did not fall under Spanish jurisdiction, M1 Legal appealed. The Malaga Court of Appeal overturned the earlier ruling. The defence argued that the cases should not be heard in Spain, stating that the contracts fell under English law. However, the appeal judge ruled in all nine cases that they can be heard in Spain.

The judge also noted that the UK address shown in the contracts is not a location where any company activity is carried out. This left the Spanish address as the relevant point of connection, supporting Spanish jurisdiction for the lawsuits.

The contractual names vary and are listed below:

  • Club la Costa UK PLC
  • Club la Costa UK PLC Sucursal en España
  • Paradise Trading S.L.

All nine cases will now be re-submitted for judgment.
