Today we can share a double victory for M1 Legal against Club La Costa.
In the first case, where the contractual party was named as Continental Resort Services S.L., the court noted that the agreement had no end date and did not set out a resolutive condition. The judge therefore declared the contract null and void and ordered Club La Costa to pay £26,050.
In the second case, with the contractual names listed as Continental Resort Services S.L. and Club La Costa (UK) Sucursal en España, the contract did not disclose key information. This included Land Registry details, as well as accommodation information such as when it could be used, for how long and what the accommodation covered. The judge again found the agreement null and void and ordered Club La Costa to pay £56,259.
