CLC triple victory on Spanish jurisdiction as appeal overturns English law defence
M1 Legal appealed an initial decision that these Club La Costa claims did not fall within Spanish jurisdiction, and the Court of Appeal overturned it. Across all three cases, the defence argued the matters should not be heard in Spain on the basis that the timeshare contract was governed by English law. That argument was rejected, and all three cases have now been re-submitted for judgment in Spain.
The contractual name shown on all three cases was: Club La Costa UK Sucursal en España.
This is another strong result for M1 Legal, taking their total number of jurisdiction victories to 22 since January 2019.
