Another Club La Costa victory on jurisdiction: Spanish courts ruled competent to hear case

Following an initial ruling that the claim did not fall within Spanish jurisdiction, M1 Legal appealed and the Malaga Court of Appeal overturned that decision. The defence argued the matter should not be heard in Spain, stating that the contract was governed by English law.

On appeal, the judge found that Club La Costa (UK) PLC Sucursal en España is a Spanish entity, and that the claim should therefore be heard in Spain.

The case was then sent back to Court of First Instance No. 3 in Fuengirola, which has now confirmed that the Spanish courts have jurisdiction to hear the claim. This is the fifth case to be re-submitted successfully under the same contractual name.
