Seven positive awards amounting to £382,398 including two Marriott cases totalling over £100k each

We are pleased to inform you of the last Spanish court victories for 2023. For December, M1 Legal secured SEVEN positive awards amounting to £382,398.  Of those, M1 secured TWO Marriott cases over £100K!.

Please see below a breakdown of the substantive results:

1st Court of Instance:

• Onagrup x 2 - The judge declared the contracts null due to lack of property and/or contract duration information. (Laws 42/1998|04/2012).  Amounts awarded - £39,775, £16,154.
• Marriott - In Marbella, the judge declared the contract null due to lack of contract duration information.  Amount awarded - £12,583.
• Marriott - Also in Marbella, the judge declared the contract null due to lack of property information (Law 42/1998).  In addition, the defendant was ordered to pay the legal fees and costs of the proceedings.  Amount awarded - £103,000.

We also received a positive award against Elite Fuerteventura and another Marriott.

Appeals:

• Club la Costa x 2 - The Court of Appeal has confirmed two judgments from the First Instance that declared the contract null due to lack of property and/or contract duration information. (Laws 42/1998|04/2012)    Amounts awarded - £19,754, £11,994.
• Anfi - The Court of Appeal has confirmed the judgment from the First Instance that declared the contract null due to lack of property and contract duration information.   Amount awarded - £22,370.
• Marriott - The Court of Appeal has confirmed the judgment from the First Instance that declared the contract null due to lack of property information.   Amount awarded - £133,000
• Royal Park Albatros - The Court of Appeal has declared the contract null and void for lack of property and/or contract duration information. In addition, the defendant was ordered to pay the legal fees and costs of the proceedings.   Amount awarded - £10,400. 

We also received a positive decision against Diamond Resorts.

All cases mentioned above will now proceed to the next step.
