Marriott, CLC, Diamond and Anfi lose in Spanish timeshare court claims this week (M1 Legal)

We are pleased to share this week’s Spanish court victories. M1 Legal secured 7 positive outcomes, with total awards of £95,265.

The individual awards are set out below.

First Instance Court

  • Marriott – The judge declared the timeshare contract null and void under the requirements of Law 42/1998, due to missing information about the accommodation and the contract duration. Amount awarded: £10,164.
  • Club La Costa – The judge also declared the contract null and void under the requirements of Law 04/2012, due to a lack of information regarding the accommodation and the contract duration. Amount awarded: £25,227.
  • Diamond Resorts (2 cases) – In both cases, the judge declared the contracts null under the requirements of Law 42/1998. The contracts did not disclose the minimum accommodation details or the contract term. Amounts awarded: £17,400 and £21,526.

Appeals Court

  • Anfi – At the First Instance Court, the judge initially confirmed the contract cancellation due to non-payment of maintenance fees, meaning the case went in Anfi’s favour. However, on appeal, the court confirmed the contract’s nullity under the requirements of Law 04/2012 because no end date was disclosed. Amount awarded: £12,181.
