We are pleased to share last week’s Spanish court results. M1 Legal secured 7 positive outcomes, with a total of £162,902 awarded. Full details are set out below.
First Instance Court results
- Club La Costa Sucursal – The contract was declared null due to missing information on contract duration and accommodation details, as required under Spanish Law 04/2012. Costs were awarded. £43,718 awarded.
- Silverpoint – The claim was brought against Silverpoint and Resort Properties. An out-of-court agreement was reached with Silverpoint’s administration, resulting in a positive outcome. Costs were awarded. £46,254 awarded.
- Anfi – The contract was declared null due to missing accommodation details, as required under Spanish Law 04/2012. Costs were awarded. £20,179 awarded.
- Club La Costa Sucursal – The contract was declared null due to missing information on contract duration and accommodation details under Spanish Law 04/2012. £23,773 awarded.
- Club La Costa Sucursal – The contract was declared null due to missing information on contract duration and accommodation details under Spanish Law 04/2012. £13,111 awarded.
We also received another positive first-instance result against Club La Costa, and an appeal submitted by Anfi was decided in favour of our clients.
Jurisdiction hearings
5 jurisdiction victories valued at £88,170
Last week, M1 Legal secured 5 jurisdiction decisions: 4 involving Club La Costa and 1 involving Diamond Resorts. The defence argued that the cases should not be heard in the Spanish courts. The court rejected those challenges, and all matters will now proceed to the next stage.
