Four wins against Club La Costa: Spanish timeshare court victories and contract nullity

We are pleased to share last week’s Spanish court victories. M1 Legal secured five results, with a total of £69,879 awarded.

First Instance Court (Spain):

  • CLC Sucursal x 3 – In three cases, the contracts were declared null due to missing information about the contract duration. Two of the contracts were also annulled for lack of property information. £48,480 awarded across the three cases.
  • CLC Sucursal – A final judgment from the judge in the 5th Court of First Instance in Fuengirola granted the claim as pleaded. The court declared the main contract null (£15,067) and ordered CLC to pay Barclays Partner Finance the loan amount of £44,193. The judgment states that CLC acted as a credit intermediary and that both agreements are linked. £15,067 awarded to our client.

There was also a positive judgment against Silverpoint.

Jurisdiction hearings (Club La Costa):

Two jurisdiction hearing victories valued at £41,616

M1 Legal also secured two jurisdiction hearing victories last week, both against Club La Costa. The defence challenged the cases being heard in Spain; the court rejected that challenge, and both matters will now move on to the next stage.
