More contracts nulled for Anfi and Club la Costa in Spanish court – £39,302 awarded

We are pleased to share last week’s Spanish court results. M1 Legal secured five positive outcomes, with a total of £39,302 awarded.

1st Court of Instance:

  • Anfi – The court declared the contract null and void due to a lack of required information (period and object), in line with the requirements of Law 42/98. £12,100 awarded.
  • CLC Sucursal – The court declared the current contract null and void due to missing information about the accommodation. A previous contract was also considered, but the judge did not find grounds to nullify it. £11,560 awarded.
  • CLC Sucursal – The court found the contract null and void due to missing information, specifically the lack of a defined contract object (accommodation). £9,717 awarded.

There were also two further positive judgements against Anfi, including an appeal brought by Anfi that was dismissed.

Jurisdiction hearings:

2 jurisdiction victories valued at £55,788

M1 Legal also secured two jurisdiction victories last week, both against Club La Costa. The defence argued that the cases should not be heard in the Spanish courts; however, those challenges were unsuccessful. Both cases will now move forward to the next stage.
