We are pleased to share last week’s Spanish court victories.
Our legal team secured 12 positive results, with total awards of £238,651.
10 cases were against CLC (contractual names: Sucursal, Paradise & Continental). In each case, the Spanish court declared the timeshare contract null due to missing key information about the accommodation, when it could be used, and the contract term. Total awarded: £199,815.
The next case was against Diamond Resorts. The contract was also declared null for the same reasons: insufficient information on the property, usage dates, and the duration of the agreement. Awarded: £15,015.
The final case was against Anfi Sales & Resorts. The Court of Appeal upheld the first-instance judgment in full, confirmed the contract nullity, and ordered Anfi to pay the legal costs. Awarded: £16,616.
4 jurisdiction wins valued at £75,627.
Last week, we also achieved four positive jurisdiction outcomes against CLC: one at first instance and three on appeal. All four cases will now move forward to the next stage.
