Quadruple Spanish court victory against Club La Costa (CLC) with contracts declared null and void

We are pleased to share last week’s Spanish court victories.

Our legal team achieved five substantive results, with a total awarded value of £65,930.

Four of these victories were against Club La Costa, under the contractual names CLC Paradise and CLC Sucursal. In each case, the court found the timeshare contract null and void due to missing or unclear information, including details of the accommodation, when the owners could use it, and the contract term. Costs were awarded in all four cases, with a combined total award of £56,472.

We also secured a further award for clients who owned at Royal Park Albatos, with £9,458 awarded.

11 positive jurisdiction results were also obtained, valued at £268,100.

Last week, there were five initial jurisdiction victories against CLC (across a mix of Sucursal, Paradise and Continental), alongside six successful appeals of earlier jurisdiction decisions. The defence argued the cases should not be heard in Spain; however, the judge ruled that the Spanish courts have jurisdiction.

All cases will proceed in due course.
