With Spanish courts closed for more than a month, it’s encouraging to be able to share several favourable timeshare judgements from Spain. Although hearings have paused, judges and court staff have continued working behind the scenes. New claims are still being accepted, but the process is taking longer than usual while the courts work through the first backlog of cases following lockdown.
We can now report four new substantive Spanish timeshare court victories. The first was against Diamond Resorts, where the contract was found to be missing key information, including which specific accommodation could be used and when. As a result, our client was awarded £16,090.
We also secured two favourable Club La Costa timeshare judgements in Spain, involving the contractual entities CLC Continental Resorts and CLC Paradise Trading. Both cases were heard in the Fuengirola court, and both clients received full awards including costs. In one case, the client was also awarded the interest on the loan used to purchase the timeshare. Combined, these two judgements totalled £38,286 awarded.
Our fourth victory was against Resort Sales & Marketing Sol SL, where the claimant received a full award including costs of £5,040.
In addition, we have been busy with jurisdiction cases and have been successful in 15 of them: one against MacDonald, one against Diamond, and the remainder against Club La Costa, involving the contractual entities CLC UK PLC, CLC Surcursal and CLC Continental Resorts.
