We had a busy week in court, with a number of timeshare cases progressing.
Our largest wins were against Club La Costa, brought under the following contractual names:
These cases were heard at Arona Court No. 5 and Fuengirola Court No. 5 in Spain. In total, we secured £70,396.17 in awards for our clients; all three clients received awards in full, including costs. The claims succeeded because the timeshare agreements were found to be missing key accommodation information, such as what could be used, at which resort, and when.
We also dealt with several jurisdiction hearings against CLC Paradise Trading and Sucursal España. We won all six, as the court found the plaintiffs were customers located in the United Kingdom, meaning they could choose where to issue the claim. We also won a further three jurisdiction hearings against Diamond Resorts, under the contractual name of Diamond Resorts Europe Limited Sucursal En España.
