Cala Pi nightmare now over: Spanish court voids Restotel contract, £84,763 awarded

In June 2010, the clients initially bought RCI points in Florida. In July 2011, they travelled to Cala Pi, Majorca with Restotel and traded in their RCI points. The clients say they were put under significant pressure to buy again, and that the product was sold primarily as an investment, with promised returns presented as guaranteed facts. Those returns never materialised and the clients began to suspect they had been mis-sold.

Their Cala Pi timeshare claim against the contractual party Medhotel S.L. (part of the Ona Group) was assigned to M1 Legal, which then filed a timeshare lawsuit in the Spanish courts. At the hearing, the court heard that the contract was in perpetuity (with no end date) and did not disclose the minimum legal requirements relating to the accommodation.

In this Spanish court timeshare ruling, the judge declared the contract null and void and ordered Restotel S.L. to pay £84,763.
