Diamond Resorts contract under the hammer: declared null and void in Spain, £17,597 awarded

The clients originally bought their timeshare from Sunterra Mijas sales S.L (now Diamond Resorts Excursion S.L.). They explained that, despite being sold the promise of high-quality accommodation during high season, they repeatedly struggled to book anything other than low-season availability. When they did manage to secure dates and arrived at the resort, they found the standard of accommodation was significantly lower than expected. The contract also failed to set out the minimum legal requirements.

Having considered the evidence, the court found the Diamond Resorts contract to be null and void because it did not disclose the required minimum legal information. The judge ordered Diamond to pay £17,597 plus interest.
