Our legal team recently won a timeshare contract dispute about jurisdiction. The contract included a clause in the appendix notes stating that any future disputes could not be brought before a Spanish court, even though the resort is based in Spain. This appeared to be designed to deter owners from pursuing claims (as resorts know that bringing a dispute in a British court can be more expensive).
Our lawyers argued that the jurisdiction clause was unlawful, and the court agreed. As a result, the matter can now proceed as a Spanish court timeshare dispute, to be heard in Spain.
